Boy Scouts of America Sexual Abuse

 

For decades, sexual abuse has been perpetrated within the Boy Scouts of America (BSA). Thousands of victims have come forward and lawsuits have been filed, forcing the BSA into bankruptcy. Now is your opportunity to hold the BSA accountable.

On February 18, 2020, the BSA filed for Chapter 11 bankruptcy as a result of lawsuits brought by survivors of childhood sexual abuse against the organization. 

During bankruptcy, the Scouts may be forced to compensate sexual abuse survivors from around the United States.

New York Child Victims Act

On February 14, 2019, New York Governor Andrew Cuomo signed into law the Child Victims Act, extending the statute of limitations for survivors of child sexual abuse. The New York Child Victims Act includes the following reforms for the protection of victims suffering from these heinous crimes: 

  • Survivors now have until age 55 to sue abusers and complicit institutions.
  • Victims of child sexual abuse now have a one-year window to sue abusers and institutions regardless of age and when the abuse occurred. This window opened on August 14, 2019, and closes on August 13, 2020.
  • People who previously filed a claim that was dismissed due to the statute of limitations can again refile their claim.

New Jersey Child Victims Act

New Jersey Governor Phil Murphy signed New Jersey’s Child Victims Act, Bill S-477, into law on May 13, 2019, protecting victims of child sexual abuse.

  • Victims in New Jersey now have a two-year window to report child sexual abuse, regardless of when the abuse occurred. This window opened on December 1, 2019, and will close on December 1, 2021.
  • Adult survivors of sexual abuse have until age 55, or seven years after discovering the cause of their injuries, whichever is later.
  • The statute of limitations on these cases has been increased from two years after discovery to seven years.
  • Immunity for non-profit organizations and public entities removed.
